At this session, the ‘template Confidentiality contract’ which is intended to be used by restorative justice programs with their respective participants during the onboarding process. The purpose of the document is to set out the rights and obligations of the participants and the program as between each other and clarify how information will be stored and used by the program. This document is intended as a starting point for programs and should be amended to fit the needs of the program. This document was developed to address the primary concern of ensuring that participants fully understand the limits of confidentiality of communications and information, while taking steps to create and preserve a protected privilege to be asserted in the event a third-party attempt to compel disclosure.
This session will have two components: the first is an information session about the nuances of confidentiality and privilege in the context of restorative practices, highlight the areas of potential liability for programs, and includes a detailed look at the newly developed template contract as a tool for protecting against that potential liability. The second component is an interactive dialogue in which attendees are encouraged to ask questions, raise perceived barriers to implanting the tools provided, and role play some intake sessions where attendees will put these tools into practice. While this session is intended to be informative, it is also intended to be mutually beneficial by helping us to highlight any areas of concern when implementing these strategies.
